Supreme Court Rules for Police Chase Accident Case

(KNX 1070) -- Cops throughout California may breathe a sigh of relief following today's state Supreme Court ruling in a case involving a fatal collision during a chase by Gardena Police. 

The decision bars the family of a man killed during a 2015 pursuit from suing the Gardena Police Department.

The man was a passenger in a suspect's pickup truck, which police tried to stop with a pit maneuver, that ended with a fatal collision.

The court finds as long as a law enforcement agency has a pursuit policy and requires all its officers to certify that they've read and understood the rules, it cannot be held liable for a pursuit accident...even if the agency failed to get 100 percent compliance.

One expert says CA may be the only state that allows officers to violate pursuit policies and not get sued.>
