Attorney Michael Avenatti in Court -- R. Kelly Challenging Avenatti Sex Tapes

Attorney Michael Avenatti appeared in court Tuesday in his embezzlement, bank, and tax fraud case. 

Federal prosecutors are asking a judge to appoint an attorney for Avenatti after he suggested he might be considering a change in legal representation. 

Meanwhile, R. Kelly appeared in court Tuesday to challenge the two sex tapes that Avenatti allegedly gave to prosecutors.

Kelly’s attorneys additionally indicated in court that something untoward was going on between Avenatti and Chicago prosecutor Kim Foxx, according to a report published by TMZ. The judge says the attorneys need to say what they mean. 

Kelly prosecutors say they believe the whole Avenatti-Foxx insinuations may simply be a stunt to delay court proceedings. 

In April, Avenatti pleaded not guilty to all charges in court. 

He was indicted earlier this month on 36 counts including wire and bank fraud.

Avenatti embezzled settlement funds and proceeds from other matters he handled for five clients and doled out small portions, sometimes labeling them as advances to prevent thefts from being discovered, prosecutors have said.

Avenatti, 48, has denied the charges, saying he had made powerful enemies and would plead not guilty and fight the case.
